2. ¿Qué hace nuestra App?
La app Camín de los Santuarios es una aplicación de uso gratuito por parte de la persona que se la descarga, y cuya finalidad es acompañar al caminante durante las etapas de su recorrido desde Oviedo hasta Santo Toribio de Liébana. Nuestro objetivo es poder asesorarte para que tu recorrido sea lo más agradable y segura posible.
El caminante se convierte en usuario, y por lo tanto, le rigen estas condiciones en el momento que descarga esta aplicación.
Con el contenido de la aplicación, tratamos de ayudar al caminante ANTES, DURANTE Y DESPUÉS DE SU RECORRIDO, con consejos expertos sobre cómo hacer el recorrido, recomendando lugares que nos parecen que pueden encajar con las personas que realizan dicho trayecto.
Legalmente no nos responsabilizamos de algún mal uso, o uso indebido, que se le dé a la aplicación por parte de los usuarios, en cuanto a poder compartir fotografías sacadas de la aplicación, de la situación de geolocalización ni de las fotografías que los usuarios tienen en sus dispositivos, guardadas o no mediante la aplicación. Los sitios que nosotros recomendamos son sitios que por referencias hemos comprobado que pueden cumplir con estándares de calidad en cuanto a su trato al caminante. Tampoco podemos, como es lógico, hacernos responsables de la atención que los sitios que recomendamos os puedan dar en el camino. Aunque nos gustaría que en caso que sea negativo nos lo hagáis saber para poder corregir nuestra aplicación en cuanto a las recomendaciones que hacemos.
Nosotros no conocemos tu perfil por lo que los consejos que damos son genéricos, son recomendaciones que son básicas para cualquier viajero aunque contamos con la experiencia propia y de otros caminantes que hacen que algunos de ellos te puedan servir. Los consejos son totalmente gratuitos por lo que puedes o no aplicarlos para tu recorrido.
3. Almacenamiento de datos en la App y en la Web
La App tiene la posibilidad como ya hemos dicho de guardar determinados datos. Puedes guardar tu recorrido, tus fotografías, tus comentarios, grabaciones de voz y videos. Hay que decir que son datos personales de tu propiedad, y que a través de la App los puedes ubicar donde tú prefieras. Damos opciones de conservarlos en el dispositivo móvil, o bien compartirlos como tú quieras. Nosotros no guardamos tus datos, ni en ningún caso los tratamos como parte de tu perfil de usuario. Solamente ponemos a disposición la plataforma para que tú decidas donde deseas tenerlos. Por supuesto no hay ninguna copia en nuestros servidores de NINGUNO de tus datos.
En la página Web no solicitamos ni guardamos ningún dato del usuario
4. Seguridad que ofrecemos a través de la App
La App, aparte del sistema de geolocalización donde queda registrado tus movimientos, tiene un sistema para poder avisar al teléfono de emergencia 112, que se pide máxima responsabilidad en su uso.
Además de este sistema, la App pone en disposición del usuario una sirena que se puede utilizar con la finalidad de ahuyentar en cualquier momento a alguna persona que presente intención de cometer algún delito.
En todo caso, y siguiendo instrucciones precisas de las Fuerzas y Cuerpos de Seguridad del Estado, hay que indicar las siguientes recomendaciones en este punto (https://www.guardiacivil.es/es/servicios/consejos/Camino_de_Santiago.html, aunque están dirigidas a los peregrinos que hacen el Camino de Santiago, son aplicables a este recorrido de Camín de los Santuarios), y que te reproducimos aquí:
– Alertcops a tu lado: La app gratuita de la Guardia Civil y del Cuerpo Nacional de Policía. Tiene múltiples utilidades y podrás comunicar cualquier alerta o emergencia desde tu dispositivo móvil en tiempo real. Tu posicionamiento se envía de manera automática a los centros operativos policiales y serás rápidamente localizado y atendido. https://alertcops.ses.mir.es/mialertcops/
– Ve siempre identificado: Lleva a mano tu DNI o pasaporte y exhíbelo a requerimiento de la autoridad competente, en caso de que seas instado a ello.
– Vigila tus pertenencias: En especial los efectos personales, dispositivos electrónicos (teléfono móvil, tablet, ordenador, cámara fotográfica), documentación, dinero y objetos de especial valor. Sobre todo en lugares sin vigilancia, de tránsito o con gran afluencia de personas. No los exhibas innecesariamente. Viaja ligero de equipaje. No lleves grandes cantidades de efectivo y repártelo entre el equipo y tus prendas de uso habitual, en sitios de difícil acceso como bolsillos interiores. Anota los códigos de seguridad PIN, PUK e IMEI de tu móvil.
– Mejor en compañía y de día: La experiencia será aún más inolvidable si la compartes en ruta. Evita caminar solo (sobre todo si eres mayor) y, a ser posible, entre los meses de noviembre y marzo. Procura hacer tus desplazamientos durante las horas diurnas y descansa o haz visitas culturales las jornadas bajo condiciones meteorológicas desfavorables.
– Que tu paso no deje huella: Respeta el medio ambiente, algo invaluable e insustituible. Usa las instalaciones para el depósito de basuras, desechos y otros desperdicios. No recolectes seres vivos (flora, fauna) o elementos del paisaje. Acampa en zonas autorizadas y habilitadas. No realices inscripciones, marcas o pintadas en piedras, árboles, hitos, cartelería informativa o cualquier otro elemento natural o señalizador. No enciendas fuego en el monte, no arrojes colillas de manera indiscriminada y alerta si observas cualquier situación de riesgo o un conato de incendio. Respeta la propiedad privada y a los vecinos y lugareños, no alterando su forma de vida cotidiana. Sé cortés también con el resto de caminantes.
– Desconfía de los extraños: Sobre todo si se aproximan demasiado con cualquier excusa (como preguntar algo u ofrecerse a ayudarte con la carga de tus pertenencias) o si chocan contigo de manera fortuita. Tampoco confíes en quien te recomiende atajos, puntos de interés o servicios fuera de ruta.
– Como si fuera tu casa: Cuida las instalaciones comunes (albergues, puntos de información, sitios de descanso y avituallamiento), hitos, fuentes, señales, paneles informativos y otros elementos indicadores de dirección. Déjalo todo como lo hallaste: los que te sigan lo agradecerán.
– Preserva el patrimonio histórico-artístico: Es de todos. Cualquiera que sea su ubicación o relevancia. Ayuda a transmitir la herencia del pasado y del presente para que pase a las generaciones futuras. Informa a las autoridades si observas algún deterioro o intención de cometerlo. No inflijas daño alguno ni expolies esta riqueza común.
– Sigue la indicación amarilla, respeta las normas viales y hazte ver: La concha, la estrella o la flecha te marcarán El Camino a seguir. No te aventures por sendas o atajos distintos, remotos o no señalizados. Tampoco por PRs o GRs. Si usas vías convencionales respeta las normas viales, extrema las precauciones y hazte ver en todo momento por medio de reflectantes o prendas llamativas. Camina siempre por sendas señalizadas; si vas por el arcén, hazlo por tu izquierda y en fila india. No cruces una carretera en una curva o en un cambio de rasante sin visibilidad. Si vas en bici o a caballo, circula por el arcén o lo más ceñido a la derecha, usa el casco y no vayas en pelotón.
– ¿Saben dónde estás?: Que tus familiares y amigos sepan con frecuencia dónde estás. Lleva siempre un dispositivo móvil de comunicación -con batería suficiente- que permita localizarte y con el que poder alertar de cualquier emergencia propia o ajena. Puedes usar algún dispositivo de rastreo y geolocalización, como los disponibles para senderistas o el propio Guardián de la app ALERTCOPS.
– Protege tu hogar mientras estás fuera: No informes a desconocidos ni en lugares públicos de tu intención de hacer El Camino. Tampoco durante la realización de éste a través de las redes sociales.
– ¡Qué buen plan!: Planifica con antelación suficiente tu ruta y deja al azar lo menos posible: desde la previsión meteorológica a la red de alojamientos, reservas, autorizaciones, distancias, dificultad, lugares de descanso, avituallamiento o sitios de interés.
– Mide tus fuerzas y evita los excesos: Sé consciente de tus posibilidades, estado de salud y condición física. Aliméntate de manera adecuada y abandona la marcha cuando sientas que las fuerzas te abandonan. No arriesgues ni te sometas a sobreesfuerzos, prácticas de riesgo o el consumo de drogas. Tampoco abuses de la ingesta de alcohol.
– Ante una emergencia o sospecha, llámanos: Como víctima, perjudicado o testigo, alerta al número universal (urgencia sanitaria, bomberos, seguridad ciudadana 112) o a las fuerzas y cuerpos de seguridad: Guardia CIVIL (062), Cuerpo Nacional de Policía (091), Policía Local (092). Son gratuitos.
5. Sistema de Geolocalización a través de nuestra App
Nuestra App dispone de un sistema de geolocalización que el usuario deberá activar en su dispositivo para que pueda ayudarle en su peregrinación. Ese sistema permite una localización segura en el momento que exista cobertura de la red de su operador de datos, o cualquier sistema wifi que pueda conectarse para la obtención de datos. Tan apenas existe en el sistema de geolocalización error de situación. Dejando constancia de todos los movimientos que durante el trayecto se tiene de cada persona que lo tiene activado.
En caso de no tener datos para que la geolocalización funcione online, seguirá funcionando offline marcando la posición aproximada del caminante. Es responsabilidad del usuario el uso que haga en cuanto a compartir la ubicación mediante el sistema de geolocalización que la aplicación pone a disposición del usuario.
6. Permisos, licencia y condiciones de uso sobre propiedad intelectual y/o industrial
Los contenidos prestados por DUNQECH IDEAS, S.L., así como los contenidos vertidos en la red a través de sus App y sus Web, constituyen una obra en el sentido de la legislación sobre propiedad intelectual por lo que se hallan protegidos por las leyes y convenios internacionales aplicables en la materia.
Todas las imágenes y diseños que aparecen en las fotografías son propiedad de su autor, por lo que queda prohibida la reproducción de las mismas, la utilización de las mismas para uso comercial o no comercial.
Los contenidos, imágenes, formas, opiniones, índices y demás expresiones formales que formen parte de las App y las Web, así como el software necesario para el funcionamiento y visualización de las mismas, constituyen asimismo una obra en el sentido del Derecho de Autor y quedan, por lo tanto, protegidas por las convenciones internacionales y legislaciones nacionales en materia de Propiedad intelectual que resulten aplicables.
El incumplimiento de lo señalado implica la comisión de graves actos ilícitos y su sanción por la legislación civil y penal.
Queda prohibido todo acto por virtud del cual los Usuarios de los servicios o contenidos puedan explotar o servirse comercialmente, directa o indirectamente, en su totalidad o parcialmente, de cualquiera de los contenidos, imágenes, formas, índices y demás expresiones formales que formen parte de las App y Web sin permiso previo y por escrito de DUNQECH IDEAS, S.L.
En concreto, y sin carácter exhaustivo, quedan prohibidos los actos de reproducción, distribución, exhibición, transmisión, retransmisión, emisión en cualquier forma, almacenamiento en soportes físicos o lógicos (por ejemplo, disquetes o disco duro de ordenadores), digitalización o puesta a disposición desde bases de datos distintas de las pertenecientes a las autorizadas por DUNQECH IDEAS, S.L., así como su traducción, adaptación, arreglo o cualquier otra transformación de dichas opiniones, imágenes, formas, índices y demás expresiones formales que se pongan a disposición de los Usuarios a través de los servicios o contenidos, en tanto tales actos estén sometidos a la legislación aplicable en materia de Propiedad intelectual, industrial o de protección de la imagen.
DUNQECH IDEAS, S.L. es libre de limitar el acceso a las App y Web, y a los productos y/o servicios en ellas ofrecidos, así como la consiguiente publicación de las opiniones, observaciones, imágenes o comentarios que los usuarios puedan hacerle llegar a través del e-mail.
DUNQECH IDEAS, S.L., en este sentido, podrá establecer, si lo considera oportuno, sin perjuicio de la única y exclusiva responsabilidad de los Usuarios, los filtros necesarios a fin de evitar que a través de sus App y Web puedan verterse en la red contenidos u opiniones, considerados como racistas, xenófobos, discriminatorios, pornográficos, difamatorios o que, de cualquier modo, fomenten la violencia o la diseminación de contenidos claramente ilícitos o nocivos.
Aquellos usuarios que envíen a las App y Web de DUNQECH IDEAS, S.L., a su departamento de sugerencias, observaciones, opiniones o comentarios por medio del servicio de correo electrónico, salvo que expresen de manera cierta e inconfundible lo contrario, en los casos en los que por la naturaleza de los servicios o contenidos ello sea posible, se entiende que autorizan a DUNQECH IDEAS, S.L. para la reproducción, distribución, exhibición, transmisión, retransmisión, emisión en cualquier formato, almacenamiento en soportes físicos o lógicos (por ejemplo, disquetes o disco duro de ordenadores), digitalización, puesta a disposición desde bases de datos pertenecientes a DUNQECH IDEAS, S.L., traducción, adaptación, arreglo o cualquier otra transformación de tales observaciones, opiniones o comentarios, por todo el tiempo de protección de derecho de autor que esté previsto legalmente. Asimismo, se entiende que esta autorización se hace a título gratuito, y que por el solo hecho de enviar por e-mail tales observaciones, opiniones o comentarios, los usuarios declinan cualquier pretensión remuneratoria por parte de DUNQECH IDEAS, S.L.
De acuerdo con lo señalado en el párrafo anterior DUNQECH IDEAS, S.L. queda autorizada igualmente para proceder a la modificación o alteración de tales observaciones, opiniones o comentarios, a fin de adaptarlos a las necesidades de formato editorial de las App y Web, sin que por ello pueda entenderse que existe en absoluto cualquier tipo de lesión de cualesquiera de las facultades morales de derecho de autor que los Usuarios pudieran ostentar sobre aquéllas.
Quedan prohibidos cualesquiera de los recursos técnicos, lógicos o tecnológicos por virtud de los cuales un tercero pueda beneficiarse, directa o indirectamente, con o sin lucro, de todos y cada uno de los contenidos, formas, índices y demás expresiones formales que formen parte de las App y Web, o del esfuerzo llevado a cabo DUNQECH IDEAS, S.L. para su funcionamiento. En concreto, queda prohibido todo link, hyperlink, framing o vínculo similar que pueda establecerse en dirección a las App y Web de DUNQECH IDEAS, S.L., sin el consentimiento previo, expreso y por escrito de DUNQECH IDEAS, S.L.. Cualquier trasgresión de lo dispuesto en este punto será considerada como lesión de los legítimos derechos de Propiedad intelectual de DUNQECH IDEAS, S.L. sobre las App y Web y todos los contenidos de las mismas.
DUNQECH IDEAS, S.L. no asumirá responsabilidad alguna ante consecuencias derivadas de las conductas y actuaciones antes citadas, del mismo modo que no asumirá responsabilidad alguna por los contenidos, servicios, productos, etc., de terceros a los que se pueda acceder directamente o a través de banners, enlaces, links, hyperlinks, framing o vínculos similares desde los websites de DUNQECH IDEAS, S.L.
7. Responsabilidad de los usuarios en cuanto al uso de la App y Web.
Tanto el acceso a la App y Web y sus enlaces como el uso que pueda realizarse de la información y contenidos incluidos en los mismos, será de exclusiva responsabilidad de quien lo realice.
Por tanto, el uso que pueda hacerse de la información, imágenes, contenidos y/o productos reseñados y accesibles a través del mismo, estará supeditada a la legalidad, sea nacional o internacional, aplicable, así como a los principios de buena fe y uso lícito por parte de los Usuarios, quienes serán enteramente responsables de dicho acceso y correcto uso.
Los Usuarios estarán obligados a hacer un uso razonable de los servicios o contenidos, bajo el principio de buena fe y con respeto a la legalidad vigente, a la moral, al orden público, a las buenas costumbres, a los derechos de terceros o de la propia DUNQECH IDEAS, S.L., todo ello según las posibilidades y fines para los que están concebidos. DUNQECH IDEAS, S.L. no asume responsabilidades, ya sean directas o indirectas, por daño emergente o lucro cesante, derivadas del mal uso de los servicios o contenidos realizado por los Usuarios o terceros. DUNQECH IDEAS, S.L. no se hace responsable de las webs no propias a las que se puede acceder mediante vínculos «links» o de cualquier contenido puesto a disposición por terceros.
Cualquier uso de un vínculo o acceso a una web/App no propia, es realizado por voluntad y riesgo exclusivo del usuario e DUNQECH IDEAS, S.L. no recomienda ni garantiza ninguna información obtenida a través de un vínculo ajeno a DUNQECH IDEAS, S.L., ni se responsabiliza de ninguna pérdida, reclamación o perjuicio derivada del uso o mal uso de un vínculo, o de la información obtenida a través de él, incluyendo otros vínculos o webs, de la interrupción en el servicio o en el acceso, o del intento de usar o usar mal un vínculo, tanto al conectar a la App o Web de DUNQECH IDEAS, S.L., como al acceder a la información de otras webs o Apps desde la App o Web de DUNQECH IDEAS, S.L.

Para evitar cualquier duda en las traducciones de nuestras condiciones, hay que tener en cuenta que nuestro idioma es el español. Ponemos a disposición de los visitantes que utilizan nuestra App o Web una traducción al inglés.

10. Leyes aplicables y sumisión a fuero
La legislación que rige esta App y Web son las leyes españolas, en protección de datos personales se estará al Reglamento Europeo sobre Protección de datos 679/2016 y la Ley Orgánica 3/2018 de 5 de diciembre, aunque recordamos al usuario que no recogemos datos de carácter personal.
Siempre que el Usuario no sea consumidor o usuario, y cuando no haya una norma que obligue a otra cosa, las partes acuerdan someterse a los Juzgados y Tribunales de Asturias por ser este el lugar de celebración del contrato como usuario, con renuncia expresa a cualquier otra jurisdicción que pudiera corresponderles.

2. What does our App do?
The Camín de los Santuarios app is an application that is free to use by the person who downloads it, and whose purpose is to accompany the walker during the stages of their journey from Oviedo to Santo Toribio de Liébana. Our goal is to be able to advise you so that your journey is as pleasant and safe as possible.
The walker becomes a user, and therefore, these conditions govern him at the moment he downloads this application.
With the content of the application, we try to help the walker BEFORE, DURING AND AFTER THEIR JOURNEY , with expert advice on how to make the journey, recommending places that we think may fit in with the people who make the journey.
Legally we are not responsible for any misuse, or improper use, that is given to the application by users, in terms of being able to share photographs taken from the application, the geolocation situation or the photographs that users have on their devices, whether or not saved through the app.
The sites that we recommend are sites that we have verified through references that can meet quality standards in terms of their treatment of walkers. Neither can we, of course, be held responsible for the attention that the sites we recommend may give you along the way. Although we would like you to let us know if it is negative so that we can correct our application regarding the recommendations we make.
We do not know your profile, so the advice we give is generic, they are recommendations that are basic for any traveler , although we have our own experience and that of other walkers that make some of them useful to you. The tips are completely free so you can or cannot apply them to your tour.
3. Data storage in the App and Web
The App has the possibility, as we have already said, of saving certain data. You can save your tour, your photos, your comments, voice recordings and videos. It must be said that they are personal data of your property, and that through the App you can locate them where you prefer. We give options to keep them on the mobile device, or share them as you want. We do not save your data , nor in any case do we treat it as part of your user profile. We only make the platform available for you to decide where you want to have them. Of course there is no copy on our servers of ANY of your data.
4. Security we offer through the App
The App, apart from the geolocation system where your movements are recorded, has a system to be able to notify the emergency telephone number 112, which requires maximum responsibility in its use.

– Alertcops by your side: The free app of the Civil Guard and the National Police Corps. It has multiple uses and you can communicate any alert or emergency from your mobile device in real time. Especially in places without surveillance, traffic or with a large influx of people . Don’t display them unnecessarily. Travel light. Do not carry large amounts of cash and distribute it between the equipment and your usual clothes, in places that are difficult to access, such as inside pockets. Write down the PIN, PUK and IMEI security codes of your mobile.
– Better in company and during the day: The experience will be even more unforgettable if you share it en route. Avoid walking alone (especially if you are older) and, if possible, between the months of November and March. Try to make your trips during daylight hours and rest or make cultural visits during unfavorable weather conditions.
– May your step leave no trace: Respect the environment, something invaluable and irreplaceable. Use the facilities for the deposit of garbage, waste and other waste. Do not collect living beings (flora, fauna) or elements of the landscape. Camp in authorized and enabled areas. Do not make inscriptions, marks or paintings on stones, trees, landmarks, information signs or any other natural or signposting element. Do not light fires in the bush, do not throw cigarette butts indiscriminately and be alert if you observe any risk situation or an outbreak of fire. – Be wary of strangers: Especially if they get too close with any excuse (such as asking something or offering to help you carry your belongings) or if they accidentally bump into you. Also, do not trust anyone who recommends shortcuts, points of interest or off-road services.
– As if it were your home: Take care of the common facilities (shelters, information points, rest and provisioning sites), milestones, fountains, signs, information panels and other elements indicating direction. Leave everything as you found it: those who follow you will appreciate it.
– Preserves the historical-artistic heritage: It belongs to everyone. Whatever its location or relevance. It helps to pass on the heritage of the past and present to pass on to future generations. Inform the authorities if you observe any deterioration or intention to commit it. Do no harm or plunder this common wealth.

– Do they know where you are?: Let your family and friends know where you are frequently. Always carry a mobile communication device -with sufficient battery- that allows you to be located and with which you can alert yourself of any emergency of your own or of another.
